After a federal judge in Florida struck down the Covid-19 mask mandate on planes and other public transportation on Monday, the Transportation Security Administration will not enforce the requirement, ruling that the Centers for Disease Control and Prevention had overstepped its authority.

According to a Biden administration official, the CDC shall continue to suggest that people wear masks on public transportation.

The CDC failed to adequately explain its rationale for the mandate, according to U.S. District Judge Kathryn Kimball Mizelle in Tampa, and did not allow public comment in violation of federal procedures for issuing new rules.

Former President Donald Trump appointed Mizelle in 2020.

At a press conference on Monday, White House press secretary Jen Psaki said the administration is reviewing the court’s decision and that the Justice Department will decide whether to appeal.
