FDA Temporarily Suspends Ban on Juul E-Cigarettes

The Food and Drug Administration temporarily suspended its ban on Juul Labs’ electronic cigarettes on Tuesday while the company appealed the agency’s decision.

On Twitter, the FDA Center for Tobacco Products stated that, “the agency has determined that there are scientific issues unique to the Juul application that warrant additional review,” but added that the additional review does not rescind the June 23 ban that ordered the company to pull its products from store shelves. “The stay and the agency’s review does not constitute authorization to market, sell, or ship Juul products,” the agency stressed.

On June 24, the vaping company received a temporary reprieve from the ban after the U.S. In order to give the court sufficient time to evaluate the case, the Court of Appeals for the District of Columbia Circuit granted a stay of the FDA decision.

To continue to stay on the market, e-cigarette producers must demonstrate that their use benefits public health by lowering nicotine intake among adult smokers or demonstrating that young teens are unlikely to be using them.

After years of regulatory delays, the original FDA recall was part of an effort to bring significant changes to the reasonably young vaping industry.
