A Florida construction firm owner might face prosecution after pulling out an assault weapon following a dispute with a black landscaper who was blocking his driveway.
Disturbing video shows David Berry, 44, marching down his driveway with an assault weapon in his hand, yelling at Jeremy Lee, 46, of J&S Outdoor Maintenance, for partially obstructing his driveway with a trailer hitch while working on a neighbor’s yard.
Berry, of Fat Finger Construction, exclaims while armed, ‘This is my property,’ after Lee’s car has already been relocated.
‘You’re not allowed to block my driveway. Don’t be a p***k.’
According to WFLA, Clearwater Police will bring the case to the Pinellas-Pasco State Attorney’s Office on potential charges of aggravated assault with a weapon against Berry.
The event, which occurred on Thursday after the father-and-daughter duo showed up to conduct landscaping work on Boylan Avenue in Clearwater, left Lee and his daughter, Carrie, 22, horrified, according to Lee.
Berry, according to Lee, had rushed out of his house, enraged that the trailer ramp was obstructing part of his driveway.
‘I immediately moved,’ Lee told WFLA. ‘I stopped what I was doing and I moved up, and like I said, just wasn’t good enough for him and I apologized to him.’
Berry has had previous run-ins with the police, as the construction firm owner has been charged with violence, burglary, and petit theft, all of which were bargained down to misdemeanors, according to Pinellas County Court records.
Lee has asked police to remove Berry’s firearms because of his past offenses and his wrath during their altercation.
