Tuesday, a grand jury in Harris County, Texas, refused to indict a man charged with murdering 9-year-old Arlene Alvarez while pursuing an armed suspect in February, according to Harris County District Attorney Kim Ogg.

According to the district attorney’s office, the murder occurred on February 14 at around 9:30 p.m., when Tony Earls and his wife went to a drive-through ATM to make a deposit.

The prosecutor’s office stated, a guy then raced up, held a pistol to the wife’s head, and demanded their money, vehicle keys, and wallet.

The office said that the couple first complied with the thief by turning over the check, money, and wallet before the robber began to flee. Earls, who exited the truck, reported hearing gunshots and believing he was being fired at, so he fired at the robber.

However, he struck a truck that managed to be passing by at the very same moment, killing Arlene Alvarez, 9, who was in the backseat, according to the district attorney’s office.

Ogg stated that the fugitive robbery suspect, who remains at large, will face felony murder charges for the homicide. There is a $30,000 REWARD for information leading to his capture.
