Russell Simmons 2018 Rape Lawsuit Dismissed by Judge

In the $10 million forcible rape lawsuit filed against him by a Jane Doe accuser, Russell Simmons has triumphed because the judge ruled the claims of the woman were too old to enforce.

On Friday, after the woman failed to respond to his tentative ruling in the case, Los Angeles County Judge Mark H. Epstein granted summary judgment in favor of Simmons.

The unidentified woman filed her lawsuit on the 23rd of March 2018 without saying a date for the alleged rape that she said had taken place at the Clarion hotel after a Def Jam concert.

Later, she admitted that the supposed incident occurred in 1988, relegating her claims to a two-year limitation period or less, the court ruled.

“Plaintiff has incontrovertibly admitted that the alleged incident occurred in 1988. In calculating the limitations period per (law), she would have had to file her action in 1990 unless the statute is tolled,” the judge ruled.

“Plaintiff has alleged tolling in the first amended complaint, asserting that defendant’s extended absence from California makes her case timely,” the judge said. “The court disagrees.”
