A 3-year-old child died Saturday after falling from a 29th-floor balcony in New York City, authorities say.

Officers located the injured child at 11:09 a.m. on a 3rd floor scaffolding. The boy was pronounced dead at a neighboring hospital.

“We believe the child exited through a window, but exactly how that occurred is under investigation at the time,” a police spokesperson told AP.

The apartment is located in the housing complex Taino Towers in Harlem.

The ordinance of New York City mandates building owners with three or more apartments to provide window guards if a child under the age of 10 resides in the apartment or if a renter or occupant requested them. It is unknown whether or not window guards were put in this unit.

The child’s death is under “active investigation,” according to the spokesman, and police are interviewing with two individuals who were in the apartment when the child fell.
