Amber Guyger, the ex-Dallas cop that shot & killed Botham Jean , lost her first appeal on Thursday, asking for her conviction to be thrown out for a lesser charge.

She was originally sentenced to 10 years for Jean’s murder. Guyger and Jean lived in the same apartment complex and she claimed she thought Jean was an intruder, even though she was in his apartment when she fatally shot him.

Guyger will be able to file another appeal at a later time. Botham Jean’s family attorney stated that they are happy with the court’s decision and shocked by results.
