Video of Maxwell Berry howling while duct-taped to an airline seat went viral in August of 2021.

Maxwell Berry, who groped and assaulted flight attendants on a Frontier Airlines flight last year, was sentenced to 60 days in jail and one year of supervised release.

Berry pleaded guilty to three counts of assault and was sentenced on Tuesday in Miami.

During an August flight from Philadelphia to Miami, the 22-year-old allegedly ordered a 3rd drink. Officials say he rubbed an empty cup against a female flight attendant’s backside.

He drank too much, went to the bathroom, and came out shirtless. A flight attendant aided him get a clean shirt from his carry-on bag. Berry then started walking around the plane for 15 minutes, “friending” another flight attendant. He groped both her and the other flight attendant’s breasts.

Berry punched a male flight attendant in the face when he was asked to watch Berry. The flight attendant and other passengers used a seatbelt extender and tape to restrain him.

Berry was apprehended upon his arrival at Miami International Airport. The incident was captured on video, with Berry screaming expletives and declaring his parents are “worth more than $2 million.”

Berry and his attorneys filed a sentencing memorandum in February, pleading guilty and requesting no jail time. “Max Berry is a good man who committed a bad act, that was not planned, it was committed in an unsophisticated manner, and it is an aberration,” the document reads.

They contended that a “non-incacerative sentence with special conditions is an appropriate sentence that is ‘sufficient but not greater than necessary’ to achieve justice in this case.”

However, the court stated in documents related to his guilty plea that Berry could still face up to six months in prison for each count, for a total of 1.5 years, plus one year of supervised release. Additionally, the court stated that he could face a $5,000 fine for each count, for a total of $15,000.

Berry was ultimately fined $2,500 and ordered to pay over $1,500 in restitution, in addition to his 60 days in jail and one year of supervised release.
